According to TMZ Sports, the prosecutors are aiming for 10 years in prison for Mahomes’ dad, essentially doubling his sentence. Three days ago, Mahomes Sr. was arrested after allegedly drinking alcohol, which is a violation of his probation for his 2024 DWI sentence.
The former MLB player was booked in Smith County Jail at 8:53 AM on Tuesday without bond after he had a high alcohol reading on his SCRAM alcohol ankle monitor on January 1. The 55-year-old was also tested for alcohol presence through urine tests conducted on January 5 and January 9. The tests are based on the fact that alcohol in our system can be detected by advanced technologies up to 80 to 120 hours after drinking. While both tests reportedly came back negative, the prosecutors are still moving forward with the charges.

His court documents also allege that he failed to complete the required three hours per month of community service.
If the court sides with the prosecution, Mahomes Sr.’s five-year probation from a similar arrest in 2024 would be revoked, and he would be sent to prison. He is scheduled to challenge the allegations at a court hearing on March 9, but under the judge’s order, he is expected to remain in jail until then.
If found guilty, he will serve the same sentence that he was originally supposed to two years ago.

No one from the family has yet commented on the recent arrest. Mahomes Sr. has reportedly been arrested for driving under the influence at least three times in the past.

Patrick Mahomes’ father used the star’s name to get out of trouble
Patrick Mahomes Sr. served a ten-day jail sentence for the DWI back in October 2024, but that was never the end of the matter. It was his third offense, which came with strict probation terms, and the consequences were always going to be big if he failed to comply.
At the time of his arrest, Mahomes Sr. was fully aware of the timing. His son was preparing to play in the Super Bowl, and he pleaded with officers to understand the situation.

“Can I say one thing?” Mahomes Sr. said at the time. “My son is getting ready to play in the f—ing Super Bowl. I am not drunk, I promise you. I’ve had some drinks, but he can’t have this right now. This can’t happen.”

The situation became a lot more complicated when he was unable to produce registration for the vehicle he was driving. He told officers the car had been given to him as a gift and said the paperwork would be taken care of within a couple of days.
“We’ve never had a star here in this area, and now we got a chance to be a star, and now we going to have a scandal now,” he said. “We’re gonna have a scandal for no f—ing reason because my registration when he gifted me the car hasn’t gotten in yet, which would probably be in the next day or two.”

Despite the incident, Patrick Mahomes went on to win the Super Bowl that year, but the situation did affect him. His father is a former professional baseball player, someone who understands how tightly athletes are judged and how quickly off-field issues become noise. He commented on the incident in an episode of the ESPN docuseries, The Kingdom.
“It was during that Super Bowl. It became a story, and so, I had to answer questions about it,” Mahomes said. “I think just knowing that it hurt me woke him up to know that, like, you can’t keep doing the same things.”

Mahomes Sr. and his legal troubles
He was arrested on February 3, 2024, just days before the Super Bowl matchup between the Kansas City Chiefs and the San Francisco 49ers, which ended with a Chiefs win. That arrest took place in Tyler, Texas, after a traffic stop revealed a blood alcohol content above 0.23. The former baseball player was facing up to 10 years behind bars and a fine of up to $10,000. However, he pleaded guilty in April 2024. He was placed on five years’ probation in September 2024, and was in his first year during this recent arrest.
“Today, Mr. Mahomes entered a guilty plea in his case pursuant to a written plea agreement,” Patrick Mahomes Sr.’s attorney, Joseph D. Murphy, told TMZ Sports at that time. “Our client is now living a sober life, and we believe that the steps he has taken to better his life have helped us negotiate a plea recommendation for probation.”
Mahomes Sr. was present in the Allegiant Stadium when Patrick won his third Super Bowl in 2024, but kept a low profile.

But before the 2024 incident, he was accused of driving while drunk in 2019. He was charged with DWI second or more and was sentenced to 40 days in jail. Reports from then suggest that he served the time on weekends to fulfill his requirement.
According to Mahomes Sr., he called Patrick right after the arrest and apologized for how the media focused more on the arrest than his Super Bowl win. But what began as another DWI case now carries the very real possibility of a decade behind bars for the 55-year-old.
Mahomes Sr. and his family are hoping the five-year probation sentence doesn’t turn into something far more severe, as all the focus now shifts to the court hearing in March.
